Buyer Agreement

1. Platform Role

LoveDOEKOE operates solely as a digital marketplace platform and does not act as a seller or service provider.

All services are provided by independent third-party sellers. LoveDOEKOE is not a party to the performance of those services and provides no guarantees regarding content, quality, outcome, or suitability.

2. Buyer Responsibilities

The Buyer is responsible for:

  • Providing accurate, complete, and up-to-date information
  • Carefully reading listings and conditions before purchase
  • Timely and respectful communication with Sellers
  • Complying with this Agreement and all other platform rules

The Buyer must also be available in time for delivery if required for service execution.

3. Orders & Payment

  • All payments are processed via Stripe Connect.
  • By placing an order, the Buyer authorizes payment of the total amount, including platform and processing fees (if applicable).
  • The paid amount is held by the Platform until: (a) delivery is accepted, (b) the confirmation window expires, or (c) a dispute is resolved.

4. Delivery & Acceptance (72 Hours)

After the Seller marks an order as delivered, a confirmation window of 72 hours begins.

Within this period, the Buyer must:

  • Explicitly accept the delivery, or
  • Open a dispute with a reasonable and well-founded explanation.

If no action is taken within 72 hours, delivery is deemed accepted and payment is automatically released to the Seller. Explicit acceptance may trigger immediate release.

5. Disputes

Disputes must be opened within the 72-hour confirmation window.

When opening a dispute, the Buyer must:

  • Provide clear and relevant information
  • Provide evidence upon request (e.g., screenshots or communication)

LoveDOEKOE evaluates disputes professionally and reasonably based on submitted information, platform/chat logs, and technical or administrative data. The administrative decision is binding.

6. Cancellations & Refunds

Cancellations and refunds are only possible in accordance with the Refund & Cancellation Policy.

No refund applies if:

  • The service has been fully delivered
  • The delivery has been accepted
  • The 72-hour confirmation window has expired
  • Access to digital content or services has been granted

Platform and Stripe processing fees are non-refundable to the extent permitted by law.

7. EU Right of Withdrawal (Digital Services)

For digital services and digital content, the Buyer agrees that delivery may start immediately after purchase.

By providing this consent, the Buyer waives (to the extent legally permitted) the right of withdrawal once delivery has started or access has been granted.

8. Abuse & Prohibited Behavior

The Buyer is prohibited from:

  • Opening fraudulent or unfounded disputes
  • Abusing chargebacks
  • Bypassing the Platform or Sellers
  • Providing false or misleading information
  • Requesting illegal or prohibited services

Abuse may result in:

  • Dispute rejection
  • Account restriction or termination
  • Permanent exclusion from the Platform

9. Account Measures

LoveDOEKOE reserves the right to restrict, suspend, or terminate accounts if:

  • There is abuse or fraud
  • This Agreement or other policies are violated
  • It is necessary to protect the Platform or other Users

Measures may be taken without prior notice if immediate action is required.

10. Liability

LoveDOEKOE is not liable for the acts or omissions of Sellers, indirect damages, consequential damages, loss of profits, or damages arising from the use of Seller services.

Any liability of LoveDOEKOE is limited to the maximum amount permitted by law.

11. Governing Law & Jurisdiction

This Agreement is governed exclusively by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.

12. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions remain fully in force.
